(A) The cancellation is made within the established time period (generally until 48 hours before<\/strong> of the date of the service, unless a different period is indicated on the tour card).<\/p>\n\n\n\n(B) The provider or Caribbean Shuttles cancels the service because of operational reasons<\/strong>.<\/p>\n\n\n\n(C) Weather or other safety conditions<\/strong> force the suspension of the activity.<\/p>\n\n\n\n4.3. No reimbursement<\/strong> when:<\/p>\n\n\n\n\n- The User does not show up (\u201cno show<\/strong>\u201d).<\/li>\n\n\n\n
- Cancellation is requested outside the allowed period<\/strong>.<\/li>\n\n\n\n
- Essential conditions of the reservation are modified without authorization.<\/li>\n\n\n\n
- The activity has already been fully or partially executed.<\/li>\n<\/ul>\n\n\n\n
4.4. The payback times<\/strong> depend on external payment processors and banks, and may take several business days.<\/p>\n\n\n\n
\n\n\n\n5. USER STATEMENTS<\/h3>\n\n\n\n
The User declares that:<\/p>\n\n\n\n
\n- It has legal capacity<\/strong> to hire.<\/li>\n\n\n\n
- Provides information accurate and up to date<\/strong>.<\/li>\n\n\n\n
- You will not use the Services for the following purposes fraudulent, illegal or harmful<\/strong>.<\/li>\n\n\n\n
- You have read, understood and accepted these Terms.<\/li>\n<\/ul>\n\n\n\n
\n\n\n\n6. OBLIGATIONS OF THE USER<\/h3>\n\n\n\n
The User agrees to:<\/p>\n\n\n\n
\n- Review the operational information<\/strong> sent by the Company (schedules, meeting points, recommendations).<\/li>\n\n\n\n
- Show up punctually at the meeting point<\/strong> indicated.<\/li>\n\n\n\n
- Comply with the safety regulations<\/strong> of each excursion or transfer.<\/li>\n\n\n\n
- Maintain private your password<\/strong> access to the Site (if you have an account).<\/li>\n\n\n\n
- Do not copy, sell, distribute or reproduce content from the Site without express authorization.<\/li>\n<\/ul>\n\n\n\n
Any misuse of the Services may result in the following access cancellation<\/strong> User's access to the Site and\/or future reservations.<\/p>\n\n\n\n
\n\n\n\n7. LIMITATION OF LIABILITY<\/h3>\n\n\n\n
The Company and Caribbean Shuttles shall not be responsible for:<\/p>\n\n\n\n
\n- Accidents, losses, personal or material damages occurred during the services, when they are a consequence of:\n
\n- Actions or omissions of the User.<\/li>\n\n\n\n
- Non-compliance with safety standards.<\/li>\n\n\n\n
- External conditions (weather, traffic, government decisions, etc.).<\/li>\n\n\n\n
- Conduct of the subcontracted supplier.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
- Delays due to traffic, weather, governmental decisions or events beyond your control.<\/li>\n\n\n\n
- Loss of personal belongings during service.<\/li>\n\n\n\n
- Site failures, availability errors or technical interruptions beyond the Company's reasonable control.<\/li>\n\n\n\n
- Actions or omissions of independent suppliers or third parties outside the corporate group.<\/li>\n<\/ul>\n\n\n\n
The Company's maximum liability, if applicable, shall not exceed the value paid for the affected service.<\/strong>.<\/p>\n\n\n\n
\n\n\n\n8. INDEMNIFICATION<\/h3>\n\n\n\n
The User agrees to indemnify and hold harmless<\/strong> the Company and Caribbean Shuttles against any claim, demand, loss, damage, fine or expense (including reasonable legal fees) arising out of:<\/p>\n\n\n\n\n- Misuse of the Site or Services.<\/li>\n\n\n\n
- Providing false, inaccurate or outdated information.<\/li>\n\n\n\n
- Breach of these Terms and Conditions.<\/li>\n\n\n\n
- Claims related to the conduct of the User during excursions or transfers.<\/li>\n<\/ul>\n\n\n\n
\n\n\n\n9. ADVERTISING AND PRIVACY<\/h3>\n\n\n\n
9.1. The User agrees to receive informational and promotional emails related to the Services, being able to deactivate them at any time<\/strong> through the mechanisms indicated in the e-mails themselves or by contacting the Company.<\/p>\n\n\n\n9.2. The treatment of personal data is governed by the Privacy Policy<\/strong> available on the Site.<\/p>\n\n\n\n
\n\n\n\n10. PROHIBITION OF DISCRIMINATION<\/h3>\n\n\n\n
The User may not request services under discriminatory criteria<\/strong> related to race, nationality, religion, gender, sexual orientation or others.<\/p>\n\n\n\nThe Company reserves the right to:<\/p>\n\n\n\n
\n- Cancel the reservation, and<\/li>\n\n\n\n
- Block users who engage in discriminatory or aggressive conduct or conduct contrary to the dignity of others.<\/li>\n<\/ul>\n\n\n\n
\n\n\n\n11. ASSIGNMENT<\/h3>\n\n\n\n
The Company may assign its rights and obligations<\/strong> derived from these Terms to any company belonging to the same corporate group, without prior notice to the User.<\/p>\n\n\n\nThe User may not assign<\/strong> your rights or obligations arising from your use of the Site or Services without written authorization from the Company.<\/p>\n\n\n\n
\n\n\n\n12. DURATION AND TERMINATION<\/h3>\n\n\n\n
12.1. This Agreement enters into force as from first use of the Site<\/strong> by the User and remains in effect as long as the User continues to use the Site or the Services.<\/p>\n\n\n\n12.2. The Company may suspend or terminate the User's access to the Site and\/or the Services if:<\/p>\n\n\n\n
\n- Breach of this Agreement.<\/li>\n\n\n\n
- Uses the service for illicit, fraudulent or immoral purposes.<\/li>\n\n\n\n
- Adversely affects the operation, security or reputation of the corporate group.<\/li>\n<\/ul>\n\n\n\n
\n\n\n\n13. APPLICABLE LAW AND JURISDICTION<\/h3>\n\n\n\n
This Agreement is governed by the laws of the Dominican Republic<\/strong>.<\/p>\n\n\n\nAny dispute or controversy arising out of the interpretation or enforcement of these Terms shall be submitted to the competent courts of the province of La Altagracia, Dominican Republic<\/strong>, unless otherwise provided by law.<\/p>\n\n\n\n
\n\n\n\n14. NOTIFICATIONS<\/h3>\n\n\n\n
Official notices in connection with these Terms may be given by:<\/p>\n\n\n\n
\n- E-mail sent to the address provided by the User, or<\/li>\n\n\n\n
- Publications visible on the Site.<\/li>\n<\/ul>\n\n\n\n
The User shall be deemed to have received the notice within a reasonable time of its dispatch or publication.<\/p>\n\n\n\n
